These Terms and Conditions (“Terms”) govern your use of the services provided by Pod42 LLC, the owner and operator of privatedatapod.com (“we,” “us,” “our”), including your Private Data Pod, connected applications, and the developer center. By creating an account or using our services you agree to these Terms.
1. The Service
We provide hosted personal data pods built on the Solid open standard. A pod is a private storage space on the web that you own and control. We operate the server infrastructure but do not access, read, or process the contents of your pod except as required to deliver the service (for example, routing requests, enforcing storage quotas, or delivering email notifications).
2. Your Account
You must provide accurate information when registering. You are responsible for keeping your credentials secure. You may not share your account with others or use automated tools to create accounts in bulk. You must be at least 13 years old to use the service.
3. Acceptable Use
You may use your pod to store personal data and connect compatible applications. You may not use the service to:
- Store, transmit, or distribute content that is illegal, abusive, threatening, defamatory, or infringes any third-party rights
- Host malware, phishing pages, or any content designed to harm others
- Conduct denial-of-service attacks or attempt to gain unauthorized access to other users’ pods or our infrastructure
- Circumvent storage quotas or abuse the free tier to avoid payment
- Use your pod as a general-purpose web hosting platform for public websites or high-traffic applications
- Violate any applicable local, state, national, or international law
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
4. Data Retention
Your pod data is retained for as long as your account is active. If you cancel your account:
- Free accounts: data is retained for 30 days after account closure, then permanently deleted.
- Pro accounts: data is retained for 30 days after the final billing period ends, then permanently deleted.
You can export your pod data in full at any time before deletion using any compatible Solid client or export tool. We do not sell or transfer your data to third parties upon account closure.
Backups (Pro tier only) are retained for 7 rolling days and are deleted permanently within 30 days of account closure.
5. Cancellation
You may cancel your account at any time from your pod settings page. Pro subscriptions are billed monthly and cancellation takes effect at the end of the current billing period; you retain Pro features until that date. We do not offer partial-month refunds except where required by law.
If we terminate your account for a Terms violation, no refund is owed.
6. DMCA and Copyright
We respect intellectual property rights. If you believe content stored in a pod on our service infringes your copyright, please send a written notice to support@privatedatapod.com including:
- Your name and contact information
- A description of the copyrighted work you claim has been infringed
- The URL or sufficient detail to locate the material
- A statement that you have a good-faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and you are the rights holder or authorized to act on their behalf
- Your physical or electronic signature
We will respond to valid DMCA notices promptly. Repeat infringers will have their accounts terminated.
7. Service Availability
We aim for high availability but do not guarantee uninterrupted service. We may carry out maintenance, apply security updates, or experience outages beyond our control. We will make reasonable efforts to notify you of planned downtime.
8. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the service, including loss of data. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Michigan, and you consent to personal jurisdiction in those courts.
11. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes by email or by posting a notice on the site. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

The services are owned and operated by Pod42 LLC. References to “we,” “us,” and “our” throughout these Terms refer to Pod42 LLC.
